Assume the bank retrieved or tried to retrieve your funds. The scammer could claim the funds were for most anything and it devolves to he said, she said. Thus the banks do not want to go there. From the banks' perspective it was a cash transaction. If you give $349 cash to a scammer he is gone. If you direct deposit $349 to an incorrect account it can also be a challenge to get it back. The amount you lost is probably of no interest to the police although the fraudster should be, and civil actions will cost you more than $349 in time and costs. As an aside, ebay has had many negative comments because they require sellers take paypal, and that is expensive to sellers.
